These Terms of Service ("Terms") govern your access to and use of the Framio mobile application, our websites, and related services (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About Framio
Framio is an EXIF photo frame and watermark app. It lets you select photos from your device, read available image metadata, preview frame styles, and create edited images for personal or professional use.
2. Eligibility
You may use the Service only if you can form a binding agreement under applicable law. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. License to use the Service
Subject to these Terms, Framio grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for lawful purposes. We reserve all rights not expressly granted to you.
4. Your photos and content
You keep ownership of photos, images, metadata, text, and other content you select, import, create, export, or share using the Service ("User Content"). Framio does not claim ownership of your User Content.
You are responsible for your User Content and for making sure you have the rights and permissions needed to edit, export, publish, or share it. You are also responsible for complying with any laws, platform rules, and third-party rights that apply to your use of images, logos, trademarks, people, locations, or metadata.
5. Local processing and backups
Framio is designed to process selected photos and EXIF metadata on your device. You are responsible for maintaining backups of your original photos and exported images. Framio is not responsible for loss, deletion, corruption, or failure to save User Content except where prohibited by law.
6. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, abusive, or fraudulent activity.
- Violate intellectual property, privacy, publicity, or other rights.
- Attempt to reverse engineer, copy, modify, or distribute the Service except as permitted by law.
- Interfere with, disrupt, or abuse the Service or related systems.
- Use the Service to create or distribute content that you do not have the right to use.
- Misrepresent Framio, our relationship with you, or the source of images you create.
7. Third-party services and platforms
The Service may rely on operating systems, app stores, device photo libraries, sharing destinations, hosting providers, or other third-party services. These third parties may have their own terms, privacy policies, fees, limitations, and availability rules. Framio is not responsible for third-party services.
8. App stores
If you download Framio from Apple App Store, Google Play, or another app store, your use may also be subject to that store's terms. App stores may handle downloads, updates, refunds, diagnostics, and other platform services under their own rules.
9. Advertising and analytics
Framio may display ads or use analytics to understand app performance, feature usage, reliability, and advertising effectiveness. Third-party analytics and advertising providers may process app, device, usage, advertising, and fraud-prevention data as described in our Privacy Policy.
You agree not to interfere with, manipulate, hide, abuse, or fraudulently interact with ads, measurement systems, or advertising network integrity checks.
10. Updates and changes
We may update, modify, suspend, or discontinue all or part of the Service at any time. Updates may add, change, or remove features. You may need to install updates to continue using some features.
11. No warranties
The Service is provided "as is" and "as available." To the maximum extent permitted by law, Framio disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and reliability.
We do not warrant that the Service will be uninterrupted, secure, error-free, or that image output, metadata display, or export results will meet your requirements in every situation.
12. Limitation of liability
To the maximum extent permitted by law, Framio and its developers, affiliates, service providers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or User Content, arising from or related to your use of the Service.
To the maximum extent permitted by law, our total liability for any claim arising from or related to the Service will not exceed the amount you paid to use the Service in the twelve months before the claim, or USD 50, whichever is greater.
13. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Framio and its developers, affiliates, service providers, and partners from claims, damages, losses, liabilities, costs, and expenses arising from or related to your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service if we believe you violated these Terms, if required by law, or if continued operation creates risk for Framio or others. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnity, and dispute-related provisions.
15. Governing law and consumer rights
These Terms are governed by applicable laws, without excluding any mandatory consumer protection rights that may apply in your country or region of residence. Nothing in these Terms limits rights you may have under laws that cannot be waived by contract.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and may provide additional notice where required by law. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
